What Happens After Your 2nd DUI?
After one previous DUI conviction on your record, Iowa courts mandate longer administrative license suspension periods after a second conviction. If you were in a drug court program at the time of your arrest for DUI, your offense will be immediately eligible for removal from your CDL motor vehicle record (MVR) if your attorney submits copies of the court administrative file or the objection is overruled.
Iowa courts require ignition interlock devices (IID) after subsequent DUI convictions as well. However, if you meet certain requirements, such as approval into the OWI First Offender or a temporary restricted license that takes effect after an operating while intoxicated (OWI) revocation, you may be exempt from the IID mandate.
In Iowa: After a 3rd DUI Conviction
After two OWI or OWV conviction convictions, any subsequent DUI conviction qualifies as a felony.
Victim Impact Panels & Victim Impact Medical Services
Sometimes, a DUI offender may be required to attend a Victim Impact Panel, an informational forum that involves speakers (such as family members of DUI victims, DUI vics, judges, and law enforcement officials) who share their personal stories and experiences associated with DUI. This 90-minute panel helps the offender understand the long-lasting impact of his or her actions on others. There are both in-person and online options for attending a Victim Impact Panel.
Current DUI Laws in Iowa
Iowa Senate Bill 1878 went into effect on July 1, 2019, and marked an overhaul of the state’s DUI enforcement penalties. The current laws can be complex, which is why you need the best lawyer in Sioux City to help you navigate your case.
Iowa DUI “Per Se" Law
In Iowa, it is illegal to operate a motor vehicle with a blood alcohol concentration (BAC) of at least 0.08 or more. Most other states have a similar BAC cut-off. However, if an accident occurs during a DUI stop or a law enforcement officer pulls you over under reasonable suspicion, a “per se” DUI law allows the court to convict you if a chemical test shows a lower level of drugs or alcohol in your system.
DUI Laws: Zero Tolerance
The DUI laws in Iowa embody a strict “zero tolerance” policy for drivers under the age of 21. Zero tolerance means if you’re driving with a BAC of 0.02% or higher, you’ll be charged with drunk driving.
Defenses for Multiple DUI Convictions
Even if you have past DUI convictions, there are several situations in which we may be able to defend your multiple DUI charges. These include potential legal errors law enforcement officers made, violations in your rights as a citizen, or the probability that another factor was responsible for your arrest.
We know the immigration consequences of multiple DUI convictions, and we can navigate your case to provide you with the most protection. We can cross-examine witnesses, negotiate for removal of charges, negotiate sentencing and plea agreements, among other defenses in your case. Do not accept defeat simply because you have a past record.
